Terms of Service
The terms governing your use of undef games — accounts, purchases, the marketplace, and our tools and services.
Effective date: June 28, 2026
undef games is a platform for games, game tools, and live services, operated by MindTenet™ LLC (“undef games”, “we”, “us”, or “our”), registered at 8225 SW Cirrus Dr, Beaverton, OR 97008, United States. These Terms of Service (“Terms”) govern your use of our websites, apps, accounts, tools, live services, developer APIs, and marketplace (together, the “Services”). By using the Services you agree to these Terms and our Privacy Policy. If you don’t agree, don’t use the Services.
Some features are new or in pre-release, and are offered “as available.” Specific products and services may carry their own additional terms, which apply alongside these.
1. Your account and identity
- You may need an account. We support email + password, passkeys, two-factor authentication, and sign-in with third parties (such as Discord, GitHub, or Google). You can link and unlink third-party logins from your account settings.
- You are responsible for your account and for activity under it. Keep your credentials secure and tell us promptly of any unauthorized use.
- You must provide accurate account information and be old enough to form a binding contract (at least 13, and older where your local law requires).
- One human, one account, unless we agree otherwise. Don’t share, sell, or transfer your account.
2. What you get when you buy
- Purchases grant you a license (an “entitlement”) to access and use a product under the terms shown at purchase — not ownership of the underlying software, files, or intellectual property.
- Entitlements may be tied to a tier and may expire, depending on the product. Some content is protected by our content-protection technology (see §7).
- Unless a product’s listing expressly allows it, entitlements are personal and may not be resold, transferred, sublicensed, or shared.
- We may modify, suspend, or discontinue products and features. If we permanently remove paid content you still have an active entitlement to, we’ll act reasonably and consistently with the Refund Policy.
3. Wallet and virtual currency
- Your account may hold a wallet with virtual balances (such as “tokens” and “cycles”). These are a limited license to use in-service features — they are not money, have no cash value, are non-transferable, and cannot be cashed out.
- We may issue, adjust, expire, or revoke virtual balances, including for reversed payments, error, or abuse. Except where the law requires or our Refund Policy provides, virtual currency and spent balances are non-refundable.
4. Subscriptions and billing
- Subscriptions renew automatically at the stated interval (for example, monthly or annual) until you cancel. Free trials, if offered, convert to paid unless cancelled before the trial ends.
- You can cancel any time; cancellation takes effect at the end of the current billing period, and you keep access until then. We don’t refund partial periods unless the law or our Refund Policy requires it.
- Prices are shown in the currency at checkout (currently USD, EUR, or GBP) and are exclusive of taxes unless stated; applicable taxes (including VAT) are calculated and added at checkout. A failed payment may lead to suspension or cancellation after a grace period.
5. Payments and processors
Payments are handled by third-party payment processors — currently Stripe (we may add others). By purchasing, you also agree to the applicable processor’s terms. We do not store your full card or bank-account number. You authorize us, through our processor, to charge your chosen payment method for the amount shown, including recurring charges for subscriptions.
6. Refunds and cancellations
Refunds are governed by our Refund & Cancellation Policy. In short: we guarantee a minimum standard, sellers on the marketplace may offer more generous terms (shown on the product), and your statutory rights always apply.
7. Content protection and IP management (“DRM”)
Some products are delivered with content-protection and rights-management technology — for example, watermarking, per-order personalization, and license enforcement that may limit copying or printing. You agree not to circumvent, remove, or interfere with these measures, and not to strip watermarks or personalization from files you receive. Sellers may choose the protection options that apply to their products.
8. The marketplace and sellers
The Services include a marketplace where sellers (creators, vendors, and developers) offer their own products, and where we also sell our own first-party products. For third-party products, the seller is the provider of the product; we facilitate listing, delivery, payment, and support tooling.
If you list or sell through the marketplace, you additionally agree that:
- You have all rights necessary to sell your product and grant the licenses buyers receive, and your product does not infringe others’ rights or violate law.
- You set your price and any product-specific terms (including a refund policy), but those terms may not fall below the minimums we set (see the Refund Policy) and must comply with law.
- We take a revenue share and pay out your earnings via Stripe Connect, subject to onboarding, identity/tax verification (including any required tax forms), minimum payout thresholds, and holds for disputes or suspected fraud.
- We may remove listings, withhold or reverse payouts, and revoke entitlements in cases of chargebacks, fraud, infringement, or breach of these Terms.
- You are responsible for your own tax obligations on your earnings.
9. Your content and licenses
- You keep ownership of content you create or upload (such as tables, sprites, configurations, or imported files). You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, back up, and display that content as needed to operate and improve the Services and to deliver it to the people you share or sell it to.
- For content you sell, buyers receive the license you set through the marketplace, delivered and protected through our systems.
- You are responsible for the rights to your content. In particular, if you import or upload third-party material (for example, a PDF sourcebook), you represent that you have the right to do so and that your use is lawful. Undef games does not grant you any rights in third-party works, and importing content is for your own lawful use.
- Copyright complaints: if you believe content on the Services infringes your rights, contact us at support@undef.games with enough detail to identify the work and the material. We will review and may remove infringing content and terminate repeat infringers.
10. Acceptable use
You agree not to: break the law or infringe others’ rights; upload malware or attack the Services; cheat, exploit, or manipulate games, wallets, or other players; reverse-engineer, circumvent, or defeat content protection or security; scrape or overload the Services or APIs; resell or redistribute access except as allowed; or use the Services to harass, defraud, or harm others. We may remove content and suspend accounts that break these rules.
11. Developer and API use
If you use our developer tools, SDKs, identity, or APIs:
- Use them only as documented and within any rate or usage limits. Don’t misuse them, probe for vulnerabilities without authorization, or use them to build a competing extraction of our data.
- You’re responsible for anything you build and for your own users’ data. Where you process personal data through our identity or billing services, you do so under the roles and terms we provide.
- APIs and features may change, deprecate, or be discontinued; we’ll be reasonable about notice where we can, but pre-release interfaces are provided “as is.”
12. Live and hosted services
Live and multiplayer services (such as hosted worlds and agent platforms) are provided on an “as available” basis. We do not guarantee uninterrupted availability, and we may update, restrict, or discontinue live features, including for maintenance, safety, or legal reasons. Beta and pre-release features may change or be removed at any time.
13. Privacy
We collect and use personal information as described in our Privacy Policy. By using the Services you consent to that handling.
14. Suspension and termination
You may stop using the Services and close your account at any time. We may suspend or terminate your access if you violate these Terms or the law, or to protect the Services or other users. Some content and account records may persist after closure as required for legal, tax, security, and anti-fraud purposes, and access tokens already issued may remain valid until they expire.
15. Disclaimers and limitation of liability
The Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, MindTenet™ LLC and its affiliates, officers, employees, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Nothing in these Terms limits liability that cannot be limited under applicable law, including your statutory consumer rights.
16. Indemnification
You agree to defend, indemnify, and hold harmless MindTenet™ LLC and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your content, your sales on the marketplace, your use of the Services, or your violation of these Terms or the law.
17. Governing law and disputes
These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-law rules. Any dispute will be resolved by binding arbitration in Portland, Oregon, except that either party may seek injunctive relief in court for intellectual-property or unauthorized-use claims, and except where your local law gives you the right to bring a claim in your own courts.
18. Changes and contact
